These Terms of Sale (“Terms”) govern the purchase and licensing of products offered by Jodev Press, LLC (“Company,” “we,” “us,” or “our”). By placing an order through our checkout pages powered by ThriveCart or accessing our digital products, you agree to be bound by these Terms.

1. Scope of Offerings and Geographic Limitation

• United States Sales Only: Our direct digital storefront and checkout facilities are intended solely for residents located within the United States. We do not sell or deliver direct digital products to purchasers outside of the United States.
• Physical Books Sold via Amazon: Physical books published by Jodev Press, LLC are sold, fulfilled, and distributed exclusively through third-party platforms, primarily Amazon. When buying print editions, your transaction, shipping, billing, returns, and customer service terms are governed entirely by Amazon’s Conditions of Use. Jodev Press, LLC is not the merchant of record for physical book sales made via Amazon.
• Direct Digital Products: These Terms apply strictly to downloadable and streamable digital products (eBooks, audiobooks, PDF guides, worksheets, and digital media) purchased directly via our ThriveCart checkouts.

2. Digital Product Licensing and Permitted Use

• Limited License: All digital products are licensed, not sold. Upon confirmation of payment, Jodev Press, LLC grants you a personal, non-exclusive, non-transferable, revocable license for individual, non-commercial use.
• Prohibited Conduct: You may not:
  • Resell, rent, lease, sublicense, distribute, or publicly display any digital content.
  • Share download links, file copies, or account credentials with third parties or upload files to shared drives, social media, or file-sharing networks.
  • Alter, edit, reverse-engineer, or remove any copyright notices, watermarks, or proprietary designations.
• Compatibility and Access: You are responsible for maintaining the appropriate hardware, internet connection, and software (such as PDF readers or e-reader apps) required to download, open, and view your purchases.

3. Pricing, Checkout, and Sales Tax

• Payment Processing: All direct digital purchases are processed securely through ThriveCart via integrated third-party payment gateways (such as Stripe or PayPal). You authorize us to charge your selected payment method for the total amount shown at checkout.
• Currency: All transactions are processed in U.S. Dollars (USD).
• Sales Tax: Applicable state and local sales taxes will be calculated and collected automatically at checkout based on your billing address and applicable state tax rules.

4. Refund and Cancellation Policy

• All Sales Final: Due to the immediate delivery and intangible nature of digital files, all digital product sales are final, non-refundable, and non-exchangeable once access or a download link has been provided.
• Technical Assistance: If you encounter a corrupted file, broken link, or technical defect that prevents access, notify us within 7 days of purchase at our support email below, and we will issue a replacement link or assist in resolving the issue.

5. Intellectual Property

All text, book content, cover designs, illustrations, audio recordings, trademarks, and trade dress are the exclusive intellectual property of Jodev Press, LLC and its licensors. Your purchase does not convey any ownership, copyright, or commercial rights.

6. Disclaimer of Warranties and Limitation of Liability

• As-Is Provision: Digital content is provided “as is” and “as available,” without express or implied warranties of any kind, including implied warranties of merchantability or fitness for a particular purpose.
• Limitation of Liability: To the maximum extent permitted by Pennsylvania law, Jodev Press, LLC, its members, managers, and agents shall not be liable for any indirect, incidental, punitive, or consequential damages arising out of your purchase or use of the materials. Our maximum aggregate liability shall not exceed the total amount actually paid by you for the specific digital product in dispute.

7. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or related to your purchase shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be instituted exclusively in the state or federal courts located in Pennsylvania, and you consent to the personal jurisdiction thereof.
